By accessing this website you agree to these terms. If you do not accept them, please do not use the site. We may revise these terms from time to time; continued use after a revision constitutes acceptance of the updated version.

Use of the website

You may view and print material from this site for legitimate business evaluation. You may not attempt to gain unauthorised access to any part of the site or its infrastructure, interfere with its operation, scrape it at a scale that degrades service, or use it to transmit unlawful or malicious content.

Services and engagements

Descriptions of services on this website are for information only and do not constitute an offer. Scope, deliverables, timelines, acceptance criteria, fees and support commitments are set out in a written proposal or statement of work agreed with you before work begins.

Where an engagement includes ongoing managed services, the applicable service levels, response targets and notice periods are stated in that agreement.

Client responsibilities

Delivery depends on timely access to your systems, accurate information about your environment, and reasonable availability of your staff for decisions and acceptance. You are responsible for holding valid licences for third-party software we configure on your behalf and for the accuracy and lawfulness of data you provide to us.

Fees and payment

Fees, payment schedules and expense handling are set out in the applicable agreement. Unless stated otherwise, invoices are payable within thirty days, amounts are exclusive of applicable taxes, and we may suspend work on overdue accounts after written notice.

Intellectual property

The content, design and code of this website belong to BHWX Technologies or its licensors. Ownership of deliverables produced during an engagement is addressed in the relevant agreement; unless it says otherwise, we retain ownership of our pre-existing materials, tools, frameworks and know-how and grant you a licence to use them as part of the delivered solution.

Confidentiality

Each party will protect the other's confidential information, use it only for the purposes of the engagement, and disclose it only to personnel and subcontractors who need it and are bound by equivalent obligations.

Third-party platforms

Our work frequently involves third-party platforms and services. Those are supplied under their own terms, and we are not responsible for their availability, pricing changes, defects or discontinuation, though we will advise on the implications and options.

Warranties and disclaimers

We perform services with reasonable skill and care in accordance with professional standards. Except as expressly stated in a signed agreement, this website and its content are provided on an "as is" basis without warranties of any kind, and we do not warrant that the site will be uninterrupted or error free.

Limitation of liability

To the fullest extent permitted by law, neither party is liable for indirect or consequential loss, loss of profit, revenue, goodwill or data. Our total aggregate liability arising from an engagement is limited to the amount specified in the applicable agreement or, where none is specified, to the fees paid for that engagement in the preceding twelve months. Nothing limits liability that cannot lawfully be limited.

Termination and governing law

Either party may terminate an engagement in accordance with the notice provisions of the applicable agreement. Sections intended to survive termination, including confidentiality, intellectual property and limitation of liability, continue to apply.

These terms are governed by the laws of the jurisdiction in which BHWX Technologies is established, and the courts of that jurisdiction have exclusive jurisdiction over disputes. Questions can be sent to support@bhwxtech.com.
